The right to strike and the International labour organisation: The legal Foundations 2014

On Tuesday 3 June 2014, during the 2014 International Labour Conference, the International Trade Union Confederation (ITUC) launched a ‘Brief’ on the legal basis for recognition of a right to strike by the International Labour Organisation.

 On Tuesday 3 June 2014, during the 2014 International Labour Conference, the International Trade Union Confederation (ITUC) launched a ‘Brief’ on the legal basis for recognition of a right to strike by the International Labour Organisation.

 In 2012 the Employers Group staged a walkout of the ILO Conference Committee on the Application of Standards on the basis that they would no longer respect the findings of the Committee of Experts regarding the right to strike. The Brief, which responds to their arguments, was drafted by the Deputy Director and Legal Adviser of the ITUC, Jeffrey Vogt, and six other international legal experts including Professor Tonia Novitz at the University of Bristol. It was written in anticipation of potential reference of this issue to the International Court of Justice or an independent internal tribunal in accordance with Article 37 of the ILO Constitution.

 The launch of the Brief took place in the Palais des Nations, where Tonia Novitz spoke on this topic together with Jeffrey Vogt and another author of the Brief, John Hendy QC.
