Paula Giliker’s book on vicarious liability cited in February 2014 Court of Appeal decision.

Professor Paula Giliker’s recent work, Vicarious Liability in Tort (Cambridge University Press, 2010) was cited by Beatson L.J. in the most recent Court of Appeal decision on vicarious liability: Cox v Ministry of Justice [2014] EWCA Civ 132. 

Professor Paula Giliker’s recent work, Vicarious Liability in Tort (Cambridge University Press, 2010) was cited by Beatson L.J. in the most recent Court of Appeal decision on vicarious liability: Cox v Ministry of Justice [2014] EWCA Civ 132.  This case, which received considerable press attention, held the Ministry of Justice strictly liable when a prisoner negligently injured the prison catering manager whilst undertaking paid kitchen work, on the basis that the relationship between prisoner and prison was “akin to employment”.  This was regardless of the fact that the prison service is obliged to offer work to prisoners and pays only a nominal wage.  It marks one of the first decisions applying the Supreme Court ruling in Various Claimants v Catholic Child Welfare Society [2012] UKSC 56; [2013] 2 A.C. 1 (commented on by Giliker in (2013) 4 Journal of European Tort Law 306-313: “Vicarious Liability ‘On the Move’: The English Supreme Court and Enterprise Liability”).
