Publication: ‘Putting Human Rights to Work’ by Dr Philippa Collins

Oxford University Press has published a new book today by University of Bristol Law School researcher, Dr Philippa Collins. The book examines whether the human rights of workers are adequately protected through employment law. Exploring the role of human rights in labour law, the book analyses the current framework of labour rights, and, looking to the future, proposes a novel solution to the lack of effective protection of human rights at work.

‘Putting Human Rights to Work: Labour Law, The ECHR, and The Employment Relation’ (Oxford University Press, 2022) reflects on the relationship between employment, labour, and human rights before conducting a detailed and critical analysis of the scope, shape, and application of domestic employment law.

The editors of the Oxford Monographs in Labour Law series that now includes Philippa’s book wrote:

“This book represents doctrinal analysis at its very best: unflinching in its critique but constructive and ambitious in its reform agenda. It deserves to be widely read by policy-makers as well as scholars and practitioners, and we are delighted to be able to include it in the series.”

Arguing that one of labour law's objectives is to safeguard workers against the threat posed to their human rights by the managerial and disciplinary powers of employers, the book assesses whether the law of England and Wales is capable of providing effective protection of the rights contained in the European Convention on Human Rights, such as the right to respect for one's privacy and the rights to freedom of expression and association.  

The book outlines serious gaps and limitations in the structures that enforce the human rights of workers, and makes an innovative proposal for a solution: a Bill of Rights for workers that would provide a high standard of protection against the many and varied ways in which employers can infringe upon the fundamental rights of individuals at work.

Dr Philippa Collins is a Lecturer at the University of Bristol. After completing her doctorate at the University of Oxford, she now researches and teaches Employment Law. Her research focuses on the relationship between human rights and employment law mechanisms, and in particular whether UK employment law is compliant with the ECHR. Her current project examines the protection of fundamental rights in light of increased use of technology in the workplace.
